DMCA policy

Copyright policy

AraPulse respects the intellectual property rights of others and expects its users to do the same. Using the service to infringe copyright is prohibited — by this policy and by the acceptable use policy, which forms part of the terms of service.

Prohibited activities

• Uploading, creating or generating content that infringes copyright.
• Using copyrighted voice samples without permission.
• Creating unauthorised derivatives of copyrighted works.
• Distributing copyrighted content without proper licensing.
• Circumventing content protection measures.

Voice generation, specifically

• Voice likeness — using someone’s voice without permission may violate their rights.
• Performance rights — voice performances may be protected by copyright.
• Commercial use — commercial use of generated voices requires proper licensing.
• Celebrity voices — creating celebrity voice clones without permission is prohibited.

Safe harbor compliance

AraPulse operates under DMCA safe harbor provisions by:

• Maintaining a designated agent for copyright notices.
• Responding promptly to valid takedown requests.
• Implementing a repeat infringer policy.
• Not interfering with standard technical measures.

Filing a takedown notice

To file a copyright infringement claim, send a notice containing the following, as the DMCA requires:

1. Identification of the copyrighted work

• Identify the work claimed to be infringed.
• Provide registration information if available.
• Include relevant copyright documentation.

2. Identification of the infringing material

• Specific URLs or locations of the infringing content.
• A description of the infringing material.
• Information sufficient for us to locate it.

3. Your contact information

• Your name, address, phone number and email.
• The rights holder’s information, if you are filing on their behalf.
• Your preferred method of contact for follow-up.

4. Good-faith statement

• A statement that you have a good-faith belief the use is unauthorised.
• Confirmation that the use is not permitted by law or by the copyright owner.

5. Accuracy statement

• A statement that the information in the notice is accurate.
• A declaration under penalty of perjury.
• Authorisation to act on behalf of the copyright owner.

6. Signature

• Your physical or electronic signature, or that of your authorised agent.

How to submit

Email the notice to dmca@arapulse.com with the subject “DMCA takedown notice”. A PDF attachment is preferred.

Processing timeline

Counter-notice

If you believe your content was removed in error or through misidentification, you may file a counter-notice containing:

1. Identification of the removed content

• A description of the content that was removed.
• Where it appeared before removal.
• The reference number from the takedown notice, if you have it.

2. Your information

• Your name, address and phone number.
• An email address for correspondence.
• Your username or account information.

3. Consent to jurisdiction

• Consent to federal court jurisdiction in your district.
• Agreement to accept service of process from the complainant.
• Acknowledgement that you understand the legal implications.

4. Good-faith statement

• A statement, under penalty of perjury, of your good-faith belief that the content was removed in error or misidentified.

5. Signature

• Your physical or electronic signature.

What happens next

1. Counter-notice received — reviewed and validated within 2 business days.
2. Complainant notified — the counter-notice is forwarded to the original complainant.
3. Waiting period — the DMCA’s 10 to 14 business-day waiting period runs.
4. Restoration — content is restored unless the complainant files a court action. You are kept informed of the status throughout.

Repeat infringers

We track DMCA notices by account and act on the pattern, not just the individual notice:

• Every takedown notice is recorded.
• Infringement patterns are tracked per user.
• Records of repeat violations are retained.
• Accounts with violations are reviewed regularly.

Appeals

• Submit a written appeal within 30 days.
• Provide evidence of legitimate use or of the error.
• Demonstrate commitment to copyright compliance.
• Complete additional copyright education if required.

Designated agent

All DMCA notices go to our designated copyright agent at dmca@arapulse.com, and must include all information required under 17 U.S.C. § 512(c)(3).

• Response time — within 24 hours for valid notices.
• Status updates — provided within 72 hours.

Safe harbor

Qualification

AraPulse relies on DMCA safe harbor protection by:

• Acting as a service provider under the DMCA.
• Maintaining a designated agent for copyright notices.
• Implementing a repeat infringer policy.
• Not interfering with standard technical measures.
• Responding promptly to valid takedown notices.

Limitations of liability

Under safe harbor provisions, AraPulse has limited liability for:

• User-generated content that infringes copyright.
• Material transmitted through our systems.
• Content cached for performance purposes.
• Links to infringing material provided by users.

Standard technical measures

We accommodate and do not interfere with standard technical measures that:

• Are used by copyright owners to identify or protect copyrighted works.
• Have been developed pursuant to a broad consensus of copyright owners.
• Are available to any person on reasonable and non-discriminatory terms.
• Do not impose substantial costs or burdens on service providers.

False claims

Perjury

Under the DMCA, false claims in takedown notices or counter-notices are subject to perjury penalties under federal law.

Material misrepresentation

Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, is liable for damages — including costs and attorney’s fees incurred by the alleged infringer, the copyright owner or the service provider.

Bad-faith claims

We reserve the right to:

• Report bad-faith claimants to the appropriate authorities.
• Refuse to process future notices from repeat false claimants.
• Seek damages for abuse of the DMCA process.
• Cooperate with legal proceedings against false claimants.

Protecting legitimate users

• Every takedown notice is reviewed with care.
• Obviously invalid claims are rejected.
• Users filing counter-notices are supported through the process.
• Serial false claimants face legal action.
